Terms of Service — Dominaite

1. Introduction

Welcome to Dominaite ("Dominaite," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of:

  • The Dominaite mobile application
  • The Dominaite website at https://dominaite.net
  • Any associated products, services, tools, or features

By using Dominaite, you agree to these Terms. If you do not agree, please do not use our services.

2. Eligibility

To use Dominaite, you must:

  • Be at least 16 years old (or the minimum age in your jurisdiction)
  • Have the legal capacity to enter into a contract

If you are under the required age, please do not use Dominaite.

3. Accounts & Security

To access certain features, you must create an account.

You agree to:

  • Provide accurate account information
  • Not share your login credentials with others
  • Be responsible for all activity under your account
  • Notify us immediately if you suspect unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions, Billing, and Free Trials

4.1 Free Trial

Dominaite may offer a 7-day free trial for new users. Once the trial ends, your subscription automatically renews unless cancelled before renewal through your Apple App Store settings.

4.2 Auto-Renewing Subscriptions

Dominaite offers monthly and/or yearly subscription plans. Billing and cancellation are handled exclusively through:

  • Apple App Store In-App Purchases, and
  • RevenueCat for subscription management

We do not process or store credit card information.

4.3 Cancellation

To cancel your subscription:

  1. Open your device Settings
  2. Tap your Apple ID
  3. Go to Subscriptions
  4. Select Dominaite
  5. Tap Cancel Subscription

Deleting the app does not cancel your subscription.

4.4 Refunds

Refunds must be requested through Apple, as we do not have the ability to issue refunds directly.

5. Acceptable Use Policy

You agree NOT to:

  • Harass, threaten, or abuse others
  • Upload illegal, harmful, or explicit content
  • Use AI features to generate harassment, threats, misinformation, or harmful content
  • Attempt to reverse engineer, scrape, or exploit the platform
  • Interfere with servers, networks, or security features
  • Use Dominaite for activities that violate any laws or regulations

Violations may result in account suspension or termination.

6. AI Tools & Accuracy Disclaimer

Dominaite uses AI to provide insights, analysis, suggestions, and conversational feedback.

You understand and agree that:

  • AI-generated outputs may contain errors
  • AI content is not guaranteed to be accurate
  • AI results may vary depending on input
  • AI outputs are not professional advice

Dominaite does not provide:

  • Medical advice
  • Mental health therapy
  • Legal or financial advice
  • Dating or relationship guarantees
  • Fitness or health guarantees

You are solely responsible for your decisions and actions.

7. User Content

By using Dominaite, you may upload content such as:

  • Text conversations
  • Photos
  • Logs, notes, and personal data
  • AI inputs and prompts

You retain ownership of your content. However, you grant Dominaite a limited, non-exclusive license to process that content for:

  • Analysis
  • AI features
  • App functionality
  • Personalization
  • Improvements to your experience

This license ends when you delete your content or delete your account.

8. Intellectual Property

All Dominaite branding, features, designs, code, and assets are owned by Dominaite LLC.

You may not:

  • Copy
  • Distribute
  • Modify
  • Sell
  • Reverse engineer
  • Reuse
  • Or otherwise exploit

Any part of Dominaite without written permission.

9. Account Deletion

You may delete your account at any time from within the app under:

Settings → Delete Account

When you delete your account:

  • Your authentication profile is removed
  • Your stored content and data are deleted
  • Subscription access is removed
  • Some financial or compliance records may be retained as required by law

Account deletion does not cancel your subscription (cancel via Apple settings).

10. Limitation of Liability

To the maximum extent allowed by law:

Dominaite is provided "as-is" and "as available"

We make no guarantees about:

  • Performance
  • Accuracy
  • Results
  • Improvement in fitness, finances, status, dating, or lifestyle

We are not liable for:

  • Loss of profits
  • Emotional distress
  • Personal outcomes
  • Data loss
  • Damages resulting from user actions or reliance on AI

Your use of Dominaite is at your own risk.

11. Indemnification

You agree to defend, indemnify, and hold harmless Dominaite LLC from any claims arising from:

  • Your use of the app
  • Your violation of these Terms
  • Your violation of any laws
  • Any content you submit

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any disputes shall be handled in the courts located in Florida.

13. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we may notify you via:

  • App notification
  • Email
  • Website announcement

Your continued use of Dominaite constitutes acceptance of the updated Terms.
